Labor and Human Rights Policy
Chapter I Principles
Article 1 Shenzhen Yite Holdings (Group) Co., Ltd. (referred to as Yite Holdings) and its subsidiaries [KAI PENG MINING SARLU in the Democratic Republic of Congo (DRC), etc.] fully respect, safeguard, defend, and protect human rights in their business locations. The objects include all Chinese and overseas employees, contractors/suppliers, local community members, and all other personnel who may be affected by the businesses of Yite Holdings and its subsidiaries.
Article 2 This policy shall apply to Shenzhen Yite Holdings (Group) Co., Ltd. and its subsidiaries.
Article 3 We acknowledge our responsibility to follow internationally recognized human rights standards and guidance, including:
1. The Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, and International Covenant on Economic, Social and Cultural Rights issued by the United Nations;
2. The Declaration on Fundamental Principles and Rights at Work issued by the International Labor Organization;
3. The Guiding Principles on Business and Human Rights issued by the United Nations;
4. The Provisions on Prohibition of Child Labor issued by the State Council of the People's Republic of China;
Article 4 We are fully aware that multi-departmental coordination is required to address any issues concerning human rights, and that close interdepartmental cooperation is the most effective way to deal with related matters. Accordingly, the Human Resources Department, Corporate Management Department, supply chain, Administrative Management Department, Production Department, and Mining Department of Yite Holdings and its subsidiaries share the important responsibility of fulfilling the Group's human rights commitments.
Chapter II Scope of Application
Article 5 We should take active actions to assess the impact on and risks of human rights in operating activities, and protect human rights in our daily operations.
Article 6 We should communicate with local communities, employees, government authorities, investors and other interested parties in the areas identified to have impact on and pose a risk to human rights, and actively establish and maintain regular communication and contact with local interested party groups.
Article 7 The Group and its subsidiaries respect everyone's rights and each cultural tradition, including those of vulnerable groups and indigenous peoples;
Article 8 The Group and its subsidiaries completely prohibit modern slavery, including all forms of forced labor, child labor, slavery or servitude, and human trafficking;
Article 9 The Group and its subsidiaries adhere to the principle of fair employment and show respect for all employees. We avoid all forms of unlawful discrimination and harassment, such as discrimination on the basis of color, race, sex, religion, ancestry, sexual orientation, gender identity or expression, disability, or age;
Article 10 The Group and its subsidiaries will only cooperate with suppliers who agree with this policy and implement ethics in business.
Article 11 The Group and its subsidiaries insist on establishing and maintaining an employee complaint mechanism, to actively handle the feedback or complaints from employees and interested parties;
Article 12 The Group and its subsidiaries strive to reduce and minimize the adverse impact of their operations on individuals, employees, and communities;
Article 13 The Group and its subsidiaries provide a work environment that ensures health and safety, fair treatment, and good working conditions in strict accordance with the principles stipulated by the International Labor Organization. Among them, working conditions include fair labor remuneration, reasonable working hours, and reasonable breaks.
Article 14 The Group and its subsidiaries fully respect laborers' freedom of association and collective bargaining;
Article 15 The Group and its subsidiaries fully respect the natural environment of their business locations;
Article 16 The Group and its subsidiaries undertake the responsibility of fully implementing, respecting, and defending the human rights of laborers in all business processes.
Chapter III Cooperation Policy
Article 17 We require all suppliers to accept and fulfill the above commitments to human rights, which is a prerequisite for them to establish business relationships with Yite Holdings and its subsidiaries. Any violation of the guidelines will undermine the cooperative relationship between the supplier and Yite Holdings and its subsidiaries, and even lead to termination of the cooperation between the two parties.
Therefore, we require that our business partners firmly prohibit the use of forced labor, as well as all forms of modern slavery and human trafficking. We also require that the employment relationship between our business partners and their employees must be based on the principle of voluntariness. We resolutely resist any violation of human rights, and demand that all suppliers must prohibit the use of child labor and any form of forced or compulsory labor, and respect and protect the basic rights of their employees.
Chapter IV Right to Interpretation
Article 18 The right to interpret, supervise, and implement this policy belongs to Shenzhen Yite Holdings (Group) Co., Ltd.
Article 19 This policy shall come into effect from the date of promulgation.
